Legislating Morality (Part 1)

I’m Bub Kuns, and today we’re talking about legislating morality. Should we or shouldn’t we?

Well, for the most part, that’s what legislation does. Laws that forbid stealing, lying in court, being cruel to animals, rape, murder, etc,.  are, in fact, legislating morality. They are saying some things are wrong and should be against the law. But, typically these days when someone throws out the phrase, “you shouldn’t legislate morality,” they are talking about sexual morality. Historically, from Babylon to ancient Greek and Roman statutes right up to the 20th century, governments realized laws legislating moral behavior — specifically sexual behavior — were important to help cultivate healthy families and societies. These days people in Western nations are arguing that sexual morality is a “personal decision” rather than a societal issue and are working to ban certain laws.

But as historians Will and Ariel Durant noted, sex is “a river of fire that must be banked and cooled by a hundred restraints.”
