Birthright Citizenship Must Be Reversed

The Supreme Court’s five to four ruling this summer granting birthright citizenship to children born here to illegal aliens and foreign visitors is one of the most consequential and consequentially wrong decisions the Court has issued in years. The backlash is growing — and rightly so. The ruling impedes deportation and hands millions of future votes to a Democrat Party that is increasingly electing socialist candidates. That isn’t a side effect. For the left, that’s the point.

Texas has led the pushback. Governor Greg Abbott ordered an investigation into whether hospitals there are actively encouraging so-called birth tourism — foreigners who travel specifically to the United States to give birth and claim citizenship for their children. He took that step only after younger, bolder Texas Republicans forced his hand. State Representative Brian Harrison called for an immediate special session of the legislature. And Bo French, who just won a stunning upset to become the next Texas Railroad Commissioner — one of the most powerful offices in the state — was even more direct. He called the ruling traitorous and said Texas should simply refuse to recognize anchor babies as citizens. Nullification, he declared, is the correct response.

These men represent the next generation of Texas leadership. And they are right.

In Washington, legislative workarounds are unlikely to go anywhere. The Supreme Court declared birthright citizenship a constitutional right, which means Congress cannot simply legislate around it. President Trump petitioned the court for a rehearing, but it is exceedingly rare for the Court to grant such a request. Birthright citizenship is a once-in-a-century issue, and this five to four decision — authored by Chief Justice Roberts and silently joined by Justice Amy Coney Barrett as the deciding fifth vote — deserves to be reconsidered.

This fight is not unlike what pro-life Americans faced after Roe v. Wade. They campaigned against it for fifty years until it fell. We hope birthright citizenship does not take that long. States control the issuance of birth certificates — and that gives them real, practical leverage to push back.
